The origin of many legal principles today, mostly now defined in legislation, comes from our common law British history.
For example, the Alberta case of R. v. Raponi, 2006 ABQB 593, has 339 paragraphs and detailed footnotes tracing relevant legal principles developed by prior court decisions.
This case is an example of the analysis and reasoning Judges apply to every decision, even though the public might not see it.
At paragraph 140, the foundation of this 2006 decision that a seizure was unlawful was based, in part, on the British decision over four centuries ago in 1604, namely Semayne's Case (1604), 5 Co. Rep. 91a, 77 E.R. 194, refers to, if not creates, the legal principle that a "man's home is his castle".
