Spousal Support BC — Entitlement, Amount, and Duration. Spousal support in British Columbia may be paid between married or common law spouses after separation. Entitlement to spousal support depends on compensatory, non-compensatory, or contractual grounds. Compensatory support recognizes economic disadvantage suffered by one spouse because of roles taken during the relationship, such as career sacrifice to raise children. Non-compensatory support addresses economic need. Contractual support arises from a cohabitation or marriage agreement. The amount and duration of spousal support are calculated using the Spousal Support Advisory Guidelines, which provide ranges based on the length of the relationship and the incomes of both spouses. The without child support formula and the with child support formula each produce different ranges. Duration may be time-limited or indefinite depending on the length of the marriage and the recipient's circumstances. Spousal support paid under a court order or written agreement is generally deductible by the payor and taxable income for the recipient under Canada Revenue Agency rules.
