Real Estate Law BC — Family Home Division and Property Transfers. Real estate is typically the largest asset in a BC separation or estate matter. Sea to Sky Law assists BC families with the legal issues that arise when real property must be divided, transferred, or sold as part of a separation, divorce, or estate administration. At separation, the family home is family property subject to division under the BC Family Law Act. The parties may agree that one spouse buys out the other's interest, that the home is sold and proceeds are divided, or that one spouse remains in the home with the children under a deferred sale arrangement. A spousal buyout requires a transfer of title from joint ownership to sole ownership and may trigger property transfer tax unless an exemption applies. The BC property transfer tax spousal exemption applies to transfers made pursuant to a court order or separation agreement. Estate property sales are required when a deceased owned real estate that must be sold to pay debts or distribute the estate to beneficiaries. The executor must apply for and receive a Grant of Probate before transferring or selling real estate held in the deceased's name alone.
