Parental Relocation BC — Moving with Children After Separation. Parental relocation in British Columbia is governed by the Family Law Act, which sets out specific notice requirements and procedures for a guardian who wishes to relocate with a child. A guardian wishing to relocate must give at least 60 days written notice to all other guardians, setting out the proposed new location, the reasons for the move, and a proposed revised parenting arrangement. The other guardian can object to the relocation within 30 days of receiving notice. If an objection is filed, the relocating guardian must apply to the BC Supreme Court for an order permitting the relocation. The court will determine whether the relocation is permitted based on the best interests of the child, considering whether the relocation will enhance the life of the child and guardian, the reasons for and against the move, the impact on the child's relationship with the other guardian, and whether a reasonable parenting arrangement can be achieved after relocation. Both internal relocations within BC and international relocations are subject to these rules. Courts carefully weigh the interests of all parties but the child's best interests are paramount.
